Countersignature Litigation

Following its first legal victory on the unconstitutionality of countersignature laws in Florida in 2003, The Council successfully challenged every remaining countersignature statute on the books in the United States. In the aftermath of the Florida decision, West Virginia voluntarily rescinded its law. Since 2004, The Council mounted - and won - countersignature challenges  in Nevada, the United States Virgin Islands, Puerto Rico and South Dakota. District Court judges in each of these jurisdictions agreed with Council lawsuits, deeming the countersignature laws unconstitutional.
